The www.yuccs.com Website uses cookies and similar technologies for the following purposes:
- To allow the proper functioning of the Website and the provision of the corresponding services;
- To perform aggregate statistical analyses to understand and improve the User's browsing experience (eg, counting the number of visitors to the Website, understanding the popularity of a product or service, etc.);
- To analyze the preferences and navigation of Users who visit the Website in order to send them advertising in accordance with the preferences expressed while browsing the web and customize the content.
The information below refers both to the use of "cookies" and to other tracking tools that may be used (unless otherwise indicated). For the sake of convenience, we will use the term "cookies" to refer to all of the various tracking technologies, except where expressly stated otherwise.
By virtue of article 13 of Regulation (EU) 2016/679 General Data Protection Regulation (the "Regulation") and Directive 58/2002 and its subsequent amendments and supplements, Simply Merino SL in its capacity as data controller, provides the following information.
1. What is a cookie
Cookies are text files that are sent from a web server (i.e., the computer where the visited website is "hosted") to the User's browser (Microsoft Edge, Mozilla Firefox, Google Chrome, Opera, Safari, etc.) and are stored on the device, fixed or mobile, used for the User's browsing. The cookie allows the Website to identify the User's device, through the information stored on it, each time the User reconnects to the Website through that device.
Through the use of cookies (or other tracking tools) we can make it easier for the User to navigate the Website, and analyze preferences and tastes through browsing verification (profiling activities) and, consequently, offer a product promotions and services more in line with the interests and expectations of the User (for example, showing advertisements in line with their interests).
Cookies can be limited to the "session" (when they are stored only for the duration of the browsing session on the Website and are deleted when the browser is closed), or "persistent" (when they are stored for a longer time, until they expire or are deleted by the User). In addition, cookies and other tracking tools can be "first-party" (when they are created and used only by the owner of the Website that issued them and are not transferred to third parties) or "third-party" (when they are issued and managed by parts other than Yuccs).
An example of other tracking tools are "tracking pixels", small pieces of code embedded in the Website that, once downloaded to the User's browser, allow the social media provider (for example, Facebook) to monitor the User’s session, collecting data for User analysis and profiling.
Cookies and tracking tools do not collect information that directly identifies the User.
2. Types of cookies (or tracking tools) used by the Website
Cookies and technical or necessary tools
These are cookies used to ensure the browsing and, therefore, the telematic transmission of data in the network. They are strictly necessary for the provision of the services offered by the Website.
These cookies can be both first-party and third-party and do not require obtaining the User’s prior express consent, since they are strictly necessary to provide the service requested by the Website’s User.
Analytical cookies
Analytical cookies, including those of third parties, allow us to understand how Users use the Website. These cookies do not collect information directly attributable to your identity or your personal data. The information collected is normally processed in an aggregated and anonymous way through the use of partial IP hiding mechanisms; Said cookies, in the presence of other security and processing minimization measures, will be equated to technical cookies and do not require obtaining the prior consent of the User.
On the other hand, if, for example, there are no such hiding mechanisms, the use of these cookies will require the User's express and informed consent.
Customization cookies
The so-called "customization" cookies allow for the User's preferences to be recorded when using the Website (e.g., the language chosen and the country of interest) or to improve the User's browsing experience within the Website (e.g., remembering the data provided by the User when filling in forms on the Website (User input cookie), recognizing the User after they have logged in to the Website (authentication cookie); these tools are not strictly necessary to browse the Website and, if preserved after the browser has been closed, require prior and explicit consent of the User. These cookies can be both first-party and third-party.
Profiling (or marketing) cookies
These are cookies designed to create User profiles, for example, in order to send them advertising that adjusts to their preferences (for example, by using these cookies, the User will be able to see advertisements for products in which they have expressed their interest while browsing other Websites). They can be first-party or third-party, session or persistent.
Other tracking tools (for example, Facebook pixels) also work in a similar way (for example, allowing ads to be displayed on the social network).
The use of these cookies and tools requires the User’s express and informed consent.
Consent will only be requested when you access the Website for the first time: afterwards, we will use a technical cookie to store your consent so that you can directly access the Website pages when you return. It is understood that your consent may be withdrawn at any time in the manner specified in section 3 of the Cookies Policy.
Other profiling tools are not used in the absence of the User's consent (e.g., spyware).
Third-party cookies
The Website uses both "first-party” cookies and tracking tools, that is, issued by Yuccs and by the Website, as well as “third-party” cookies and tracking tools (for example, Google Analytics, social network cookies, etc.), that is, tools that are issued and managed by subjects other than Yuccs.
On the Website you can also find social buttons/widgets (social network modules), that is, specific "buttons" that represent the icons of social networks such as Facebook, Instagram, Twitter, etc. These buttons allow Users who are browsing the Website to access and interact directly with social networks by clicking on them. For more information, see Section 8.
3. Your consent
When accessing the Website, the User will see a warning "banner" about the cookies and other tracking tools eventually used.
The banner provides summarized information so that the User can understand what cookies/tools are used and to what end; In addition, using the "settings" button, the User can also check in detail what types of cookies and tools are used. Therefore, the User is free to choose whether to allow cookies and other tracking tools and which of them to allow.
We will remember if the User has given or denied their consent to allow direct access to the pages of the Website without having to view the "banners" again, except in particular cases.
(e.g., if the User deletes their cookies, if Users need to be updated regarding the cookies used, etc.).

4. Disable/delete cookies through the web browser
In any case, cookies can be deactivated/activated or eliminated through the configuration of your web browser. In particular, if you do not wish to receive cookies, you can set your browser to notify you of the presence of cookies so that you can decide whether to accept it or not; You can also automatically reject all cookies by activating the corresponding option in your browser. Finally, you can also delete specific cookies that have already been stored in your browser, block specific Websites from storing cookies on your computer, or block third-party cookies.
Each browser (Firefox, Chrome, Edge, Safari, Opera, etc.) has its own cookie management method: in the configuration panel or in the preferences panel you can modify/manage the parameters related to cookies or cancel them. 5. Who will have access to your data
The data collected through cookies and other tracking tools will not be disclosed to the public and will be processed by specifically authorized persons within Yuccs (in particular, within the customer relationship management, e-commerce, marketing, and IT departments).
In order to manage the Website and, if you give your consent, to analyze your preferences, your browsing and allow you to see content and promotional advertisements that may be of interest to you, the data will be processed by i) companies in charge of managing the Website and ii) IT service providers. These people will act as data processors designated by Yuccs.
5.1 Social Networks
The data related to browsing the Website may be transmitted in some cases to social networks (such as Facebook, Instagram, etc.; you can check the list of social networks that interact with the Website in the following table). In general, the interaction between a website and a social network is used, for example, to:
- Allow users to login through the social network (e.g., when you opt to log in to the reserved area of the Website using Facebook, data is exchanged between the social network and the Website to enable User recognition and authentication);
- allow content sharing on social networks (e.g., if you use the sharing function - the so-called social plug-in -, you can publish and, therefore, share, within your social network profile, content of interest);
- show promotional and advertising content when social networks are visited (e.g., social networks may show advertisements related to the Yuccs brand and the products that have been displayed on the Website). This can be done mainly two different ways:
- The data related to the User's navigation within the Website and collected through cookies or other tracking tools will be shared with social networks, which, by identifying the User, will show advertising content, then provide Yuccs with statistics on the advertising campaigns conducted.
- if the User has provided their email address, the data may be shared (encrypted and protected) with the social network, which, by identifying the User by email, will show advertising content, then provide Yuccs with statistics about the advertising campaigns conducted.
For such processing, the social networks will process the data —as joint controllers (art. 26 of the RGPD)— to the extent necessary to allow, for example, the display of news or advertising related to Yuccs.
Information on the processing conducted by the social networks within the Website is reproduced below:
Facebook (e.g., Facebook, Instagram), the joint controller is Meta Platforms Ireland Ltd. 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland. A joint controller agreement (art. 26 of the Regulation) regulates the processing of personal data conducted through the monitoring tools provided by Facebook and present on the Website: the agreement establishes the liabilities in relation to the respect for obligations contemplated by the Regulation regarding joint processing.

On the other hand, Facebook is the autonomous controller of the subsequent processing of User data. As the controller, Facebook is liable for providing interested parties with information regarding the processing conducted or allowing the exercise of confidentiality rights (arts. 15-20 of the Regulations). The Website uses cookies and Facebook tracking tools (e.g., pixels) to i) show Users personalized advertising and promotional content, ii) provide statistical reports on advertising campaigns and User navigation on the Website, iii) improve the publication of contents on the Website.
For these purposes, the data related to the User's navigation within the Website and collected through cookies or other tracking tools will be shared with Facebook. https://www.facebook.com/about/privacy.

6. What are your rights
By writing to support@yuccs.com you can exercise at any time the rights conferred by articles 15 to 22 of the Regulations, among others:
- obtaining confirmation about whether or not personal data concerning you is being processed;
- obtaining access to your personal data (for example, by checking what data is being processed, for what purposes and in what way);
- achieving the rectification of inaccurate personal data or the completion of incomplete personal data;
- achieving the deletion of your personal data (for pertinent purposes);
- achieving the limitation of the processing of your personal data (for pertinent purposes);
- receiving your personal data in a structured format, for common use and mechanical reading (for pertinent purposes).
You can also always oppose data processing, in particular, for analysis and profiling purposes, or for marketing, and withdraw your consent (see Section 3 and Section 8 below).
7. Transfer of data outside the European Union
Generally, the data collected through the Website is not transferred abroad, since the processing operations are conducted by providers that use servers located within the European Union (or in the European Economic Area).
On the other hand, the data collected using cookies and other tracking tools —especially social network tools— may be transferred outside the European Union (e.g.: the data collected through Facebook tracking tools are subject to transfer). The applicable confidentiality regulations provide that specific consent is not required for the transfer when it is made to a country that guarantees an adequate level of protection (art. 45 of the Regulation) or in accordance with the adoption of adequate guarantees (articles 46 and 47 of the Regulation) and, in particular, in accordance with the adoption of binding rules for groups of companies or the adoption of contractual clauses approved by the European Commission: the transfer of data collected through cookies/tracking tools is regulated by such contractual clauses (z.B. https://www.facebook.com/help/566994660333381?ref=dp).
